Defending a Forced Marriage Application
The Difference Between Arranged Marriages and Forced Marriages
There is a great difference between an arranged marriage and a forced marriage. In arranged marriages, the families of both spouses take a leading role in arranging the marriage – but the choice of whether or not to accept the arrangement remains with the young people. A forced marriage is where one or both people do not (or in cases of people with learning disabilities, cannot) consent to the marriage and then some elements of pressure or abuse are used. Forced Marriage is justly recognised in the UK as a form of violence against women and men, domestic abuse, child abuse and a serious abuse of human rights.
Has a Forced Marriage Protection Order Been Taken Out against You?
If a Forced Marriage Protection Order has been sought against you, but you feel that your actions did not justify it – you can contact Ashmans Solicitors to get advice. Ashmans Solicitors Family Law Team advise people who are seeking help on all Family Law matters – including the subject of Forced Marriage Protection Orders. Please lose no time in getting in touch with us. CALL US ON 0333 009 6275. Alternatively, you can email us at firstname.lastname@example.org Below we lay out the reasons you might have for wishing a family member to enter into a marriage:
- Controlling their unwanted behaviour;
- controlling someone who wants to live their life in a Westernised manner;
- controlling unwanted sexuality;
- preventing unwanted relationships, e.g. outside ethnic, cultural, religious or caste groups;
- protecting family honour;
- attempting to strengthen family links;
- achieving financial gain; or
- obtaining immigration advantages, i.e. by assisting claims for UK citizenship.
However, if the family member is being made to get married, or has already been made to get married against their will – then that is a punishable offence. If you feel that you have not taken part in the arrangement of a Forced Marriage, then there are processes that we can instigate through the Courts, on your behalf.
