If the police have ‘reasonable grounds’ to suspect that you have been involved in a crime or offence, they can arrest you and conduct an ‘interview under caution’. However, they can request that anyone meet them for a ‘voluntary interview’ regardless of the evidence against them. Remember that anything you say during a voluntary ‘interview’ or ‘discussion’ will be recorded and can be used against you, just as if you had been under arrest. That is why you should have a solicitor or a similar representative to protect your rights.

After the interview or questioning, the police may make a decision whether or not to charge you with a crime or offence, or they may wait to conduct further investigations. For serious matters, they must bring the Crown Prosecution Service into the matter, which can delay things substantially.

If the matter is to be investigated further, you might be ‘released under investigation’, or released under police bail (with or without conditions). Initial bail is limited to 28 days, though the police and the courts can both extend this period.
This cannot be overstated. Especially in the early stages of an investigation, the police will interview witnesses and even suspects without advising them of their right to have a solicitor present to assist them.
