Notable Case Outcome: Not Guilty Verdict

The Allegations

Our client was accused of conspiring with eleven other individuals to defraud Barclays Private Client International Bank by securing mortgage loans based on false information. The Prosecution alleged this was part of a highly organised conspiracy involving high-value properties and offshore companies registered in the Isle of Man and the British Virgin Islands. 

The case involved multiple professionals, including: property dealers, chartered surveyors, mortgage brokers, bank managers and solicitors. The Prosecution argued that each defendant played a role in the conspiracy. If found guilty, the charges would carry severe penalties and thus required our detailed understanding of financial and legal complexities. 

The Allegations

Our client was charged with conspiracy to defraud HMRC of a significant amount of duty payable on millions of cigarettes. The Prosecution alleged that our client was part of a larger group who were all engaged in an organised scheme to evade cigarette duty. The evidence included complex telephone records and surveillance material which purportedly linked our client to the conspiracy.  

The charges carried severe penalties, requiring our thorough and meticulous legal defence. 

The Allegations

The case involved identity theft, forging bank documents, and fraudulently obtaining money from financial institutions. The Prosecution further alleged that these funds were then ‘laundered’ through elaborate financial transactions and property investments.

The prosecution alleged that the defendants, including an accountant, a financial advisor, and solicitors, were behind a sophisticated fraud scheme. The charges claimed they used the internet to alter Land Registry records, applying for fraudulent mortgages or remortgages on various properties. Funds, distributed by Birmingham Midshires and The Mortgage Business (both part of Halifax Bank of Scotland), were then laundered through multiple accounts, with large sums duly sent onwards to Pakistan. 

Our client, together with co-defendants, was accused of using personal details without consent and falsifying Land Registry records to secure mortgages, which led to charges of: ‘conspiracy to commit fraud by false representation’, ‘perverting the course of justice’, and ‘transferring criminal property’. 

These allegations carry severe penalties, including significant prison time and the confiscation of money, so the stakes were extremely high.

The Allegations 

Our client, alongside three other individuals, faced allegations of conspiracy to launder £34 million over a six-year period. The Prosecution alleged that funds were taken from the UK to Pakistan and other countries through Money Service Businesses (MSBs) and Foreign Exchanges, as part of a sophisticated money-laundering operation. 

The charges stemmed from an extensive multi-agency investigation involving significant financial and transactional evidence. If convicted, our client faced severe penalties, including potential imprisonment.
