Blackmail

Blackmail is an offence under section 21 of the Theft Act 1968. It occurs where a person makes an unwarranted demand with menaces, intending to make a gain for themselves or cause a loss to another. “Menaces” can include threats of violence, exposure, or other forms of serious pressure.

Blackmail is an indictable-only offence and carries a maximum sentence of 14 years’ imprisonment. The court will consider the seriousness of the threats, whether violence was involved, the level of harm caused, and the defendant’s role in the offence.
