Coercive & Controlling Behaviour  

Coercive or controlling behaviour is an offence under section 76 of the Serious Crime Act 2015. It involves a pattern of behaviour within an intimate or family relationship that is controlling or coercive, has a serious effect on the alleged victim, and where the accused knew or ought to have known the behaviour would have that effect. 

A conviction for coercive or controlling behaviour can result in up to five years’ imprisonment, a fine, or both. The court may also impose restraining orders and other protective measures. Sentencing depends on the seriousness of the conduct, the alleged impact and any aggravating or mitigating factors.

Yes. The offence does not require physical assault. A course of conduct involving emotional, psychological, financial or behavioural control can amount to an offence if the legal threshold is met. 

Yes. The prosecution must prove repeated or continuous behaviour that had a serious effect on the complainant, such as causing fear of violence on at least two occasions, or serious alarm or distress that substantially affected their day-to-day activities.
