Making or Supplying Hacking Tools and the Law
The primary statutory basis for this offence is the Computer Misuse Act 1990, as amended (notably Section 3A) which criminalises the making, adapting, supplying or offering to supply any article (including programs or data in electronic form) intending it to be used to commit, or to assist in the commission of, an offence under sections 1, 3 or 3ZA of the Act.
- Any program or data held in electronic form designed to facilitate unauthorised access or impairment.
- The act of adapting or offering to supply such software where the supplier intends it be used unlawfully.
- Cases where the supplier believes it is likely the article will be used to commit a CMA offence.
- The defendant made, adapted, supplied, offered to supply (or obtained) an article (including software).
- The article was intended, or believed likely, to be used to commit an offence under section 1, 3 or 3ZA of the Computer Misuse Act.
- The defendant’s mental state satisfies intention or belief elements in the statute.
