Online Fraud & Identity Theft 

Online fraud generally involves dishonestly making false representations, failing to disclose information or abusing a position for gain or to cause loss, carried out through the internet or digital platforms. Most offences are prosecuted under the Fraud Act 2006 and may also involve the Computer Misuse Act 1990 where unauthorised access to systems is alleged. 

Identity theft typically involves obtaining and misusing another person’s personal data without consent. Identity fraud occurs where that information is then used dishonestly, for example to open bank accounts, obtain credit or make purchases. These offences can fall under the Fraud Act 2006 and related legislation. 

Online fraud offences can carry serious penalties, including substantial fines and up to 10 years’ imprisonment, depending on the nature and value of the alleged fraud, the level of planning involved and your role in the offence. Confiscation proceedings under the Proceeds of Crime Act 2002 may also follow a conviction.
