Under England & Wales law, the primary legislation is the Animal Welfare Act 2006. This Act makes it an offence to cause unnecessary suffering to any protected animal or to fail to meet its basic welfare needs.
- Causing unnecessary suffering to an animal, whether deliberate or through neglect
- Failing to provide adequate food, water, shelter, or veterinary care.
- Involvement in organised cruelty such as fighting, baiting or mutilation.
- Was responsible for the animal at the relevant time.
- Knew, or ought reasonably to have known, that the animal was suffering or neglected.
- Failed to take reasonable steps to prevent or stop the suffering.
Investigations may involve the RSPCA, Crown Prosecution Service, local authorities, police or, in some cases, the Animal and Plant Health Agency.
Evidence often includes veterinary reports, witness statements, photographs, CCTV and expert assessments of the animal’s condition. Serious animal welfare cases can carry penalties of up to five years’ imprisonment, depending on the facts and seriousness of the case.
