Rape in a Domestic Setting

Under the Sexual Offences Act 2003, rape occurs where a person intentionally penetrates another person’s vagina, anus or mouth with their penis without consent and without a reasonable belief in consent. Consent must be given freely and with capacity. Allegations within domestic relationships are treated with the same seriousness as any other rape allegation.

Rape is an indictable-only offence tried in the Crown Court and carries a maximum sentence of life imprisonment. A conviction also leads to mandatory notification requirements, commonly known as the Sex Offenders Register, and may result in Sexual Harm Prevention Orders or Restraining Orders.
