Under Section 2 of the Computer Misuse Act 1990, it is an offence to gain unauthorised access to a computer with the intent to commit or facilitate the commission of further offences.

It can result in a custodial sentence of up to five years’ imprisonment in the Crown Court, as well as fines and a criminal record. The sentence depends on factors such as the level of sophistication, financial loss and harm caused.
