Assault by Strangulation and the Law

Under Section 75A of the Serious Crime Act 2015, as amended by the Domestic Abuse Act 2021, it is an offence to intentionally strangle another person or do any act that affects their ability to breathe and amounts to suffocation.

Assault by strangulation or suffocation is an offence under section 75A of the Serious Crime Act 2015, as amended. It involves intentionally strangling another person or doing another act that affects their ability to breathe, such as covering their mouth or nose. Visible injury is not required for the offence to be made out. 

Assault by strangulation is an either-way offence and carries a maximum sentence of up to five years’ imprisonment. The court will consider factors such as harm, intent, previous convictions and whether the offence forms part of a wider pattern of domestic abuse.
