Assisting Unlawful Immigration Defence Specialists
Assisting Unlawful Immigration allegations can place your liberty, reputation and finances under serious pressure. These cases often involve travel records, communications, financial material, alleged networks and questions about what you knew or intended.
With a team of skilled serious organised crime specialists, Ashmans Solicitors are here to assist, whether:
- You’re under investigation or facing charges for assisting unlawful immigration under the Immigration Act 1971 or the Nationality and Borders Act 2022
- You want to protect your rights and ensure a fair and lawful investigative process
- You want a strategic legal defence from a strong yet sensitive team of experts
With Ashmans, you do not have to deal with the process alone. We help you understand the allegation, avoid harmful steps and respond carefully.
Assisting Unlawful Immigration and the Law
Under Section 25 of the Immigration Act 1971, it is an offence to assist unlawful immigration to a member state, including facilitating illegal entry or remaining in the United Kingdom.
- Transporting or harbouring an individual you know or suspect to be unlawfully entering or remaining in the UK.
- Providing false documents, accommodation, or employment to facilitate unlawful entry.
- Organising or aiding the movement of individuals across borders without authorisation.
- Knew or had reasonable cause to believe the person’s entry or stay was illegal.
- Intentionally acted to facilitate or assist that entry or stay.
- Participated in a criminal enterprise or arrangement connected with illegal immigration
Investigations may involve the police, CPS, immigration enforcement teams, financial investigators and digital evidence. Evidence can include travel records, phone data, messages, financial records, witness statements, surveillance material and documents.
These cases may overlap with allegations of money laundering, document offences or trafficking. Our solicitors review the evidence carefully, including knowledge, intent, role, financial material, communications and how the investigation has been handled.

Essential actions against accusations
From the moment of arrest, allegation or investigation, your response can affect the case. Follow these steps:
Act fast, engage Ashmans, protect your future.
Do not contact co-suspects, witnesses or alleged migrants, and do not discuss the matter online. Anything said may be used as evidence.
Even if you believe you have done nothing wrong, do not answer police questions or provide statements without your solicitor present.
Ashmans can provide urgent legal advice and police station representation where required.
Keep travel records, communications, financial documents and electronic data that may assist your defence. Do not delete or alter material.
Follow any bail or court-imposed conditions and allow your legal team to manage the defence strategy.
