Manslaughter and the Law
Under England & Wales law, manslaughter is governed primarily by common law, shaped by key statutes such as the Homicide Act 1957. It applies where a person unlawfully kills another but lacks the intent required for murder.
- Voluntary manslaughter where the defendant had intent to kill or cause grievous bodily harm but mitigating circumstances (e.g. loss of control or diminished responsibility) reduce the offence from murder.
- Involuntary manslaughter where death results from gross negligence or unlawful but unintentional acts.
- Corporate manslaughter where an organisation’s gross breach of duty of care leads to death, under the Corporate Manslaughter and Corporate Homicide Act 2007.
- Caused the death of another human being.
- Acted unlawfully or with gross negligence.
- Had conduct that a reasonable person would regard as carrying a serious risk of death.
Investigations may involve multiple agencies such as the Crown Prosecution Service (CPS), National Crime Agency (NCA), Serious Fraud Office (SFO) (for linked financial elements), or HM Coroner’s Office.
