Under England & Wales law, manslaughter is governed primarily by common law, shaped by key statutes such as the Homicide Act 1957. It applies where a person unlawfully kills another but lacks the intent required for murder.
- Voluntary manslaughter where the defendant had intent to kill or cause grievous bodily harm but mitigating circumstances (e.g. loss of control or diminished responsibility) reduce the offence from murder.
- Involuntary manslaughter where death results from gross negligence or unlawful but unintentional acts.
- Corporate manslaughter where an organisation’s gross breach of duty of care leads to death, under the Corporate Manslaughter and Corporate Homicide Act 2007.
- Caused the death of another human being.
- Acted unlawfully or with gross negligence.
- Had conduct that a reasonable person would regard as carrying a serious risk of death.
