Fail to Produce Documents and the Law
Under Section 165 of the Road Traffic Act 1988, it is an offence to fail to produce a driving licence, insurance certificate, or MOT when required by a police officer. This request can occur at the roadside or later at a police station within seven days — commonly referred to as a “producer.”
- Not providing a valid insurance certificate when asked.
- Failing to show your driving licence upon police request.
- Not producing an MOT or test certificate for the vehicle.
- Was lawfully required to produce the document by a constable.
- Failed to produce it immediately or within the specified period.
- Had no lawful excuse for the failure or lack of document.
Cases may involve the police, CPS and DVLA. Evidence can include police records, ANPR data, insurance database checks, DVLA records and correspondence.
Penalties can include a fine and, in some cases, licence endorsement or linked allegations such as Driving Without Insurance. Our Fail to Produce Documents Solicitors review the request, timing, documents and any lawful explanation.

Essential actions against accusations
From the moment police ask you to produce documents, your response can affect the case. Follow these steps:
Act quickly, instruct Ashmans, protect your driving record.
Do not argue with officers or make comments that could later be misinterpreted or used as evidence.
Even if the situation seems straightforward, avoid detailed explanations before speaking with a Motoring Defence Solicitor.
With 24/7 availability, Ashmans Solicitors can provide urgent advice and legal support when needed.
Keep copies of your licence, insurance certificate, MOT and correspondence that may help explain the situation.
If you must produce documents within a set time, follow the correct process while taking legal advice.
