Fail to Stop/Report Defence Specialists
A moment of panic, confusion or misunderstanding after a road incident can quickly become a serious allegation. A Fail to Stop/Report offence may lead to penalty points, fines, disqualification or custody in more serious cases.
Our Motoring Offence Solicitors understand how overwhelming this can feel.
- You’re worried about what happens next.
- You’re concerned about your licence, job or good name.
- You want clear legal guidance you can trust.
At Ashmans, our Fail to Stop/Report Solicitors handle every stage, from police interviews to court representation, so you are not left to deal with the process alone.
Fail to Stop/Report and the Law
Under Section 170 of the Road Traffic Act 1988, a driver involved in a road accident must stop and exchange details with any person reasonably requiring them, and if that is not possible, report the incident to the police as soon as practicable and within 24 hours.
- Failing to stop at the scene of an accident where injury or damage occurred.
- Failing to give name, address, or vehicle details when required.
- Failing to report the accident to the police within the legal time frame.
- Was the driver of a vehicle involved in an accident causing injury or damage.
- Knew, or ought reasonably to have known, that an accident had occurred.
- Intentionally failed to stop or report the incident as required by law.
Investigations usually involve the police and, where charged, the CPS. Evidence may include witness statements, CCTV, vehicle damage evidence, insurance records, phone data or telematics.
Our Fail to Stop/Report Solicitors review the evidence carefully, including knowledge of the incident, timing, reporting steps and any explanation for what happened.

Essential actions against accusations
From the moment you become aware of an allegation or investigation, your response can affect the case. Follow these steps:
Act quickly, instruct Ashmans and protect your driving future.
Do not contact anyone involved or discuss the matter publicly. Statements may later be used as evidence.
Even if you believe you have done nothing wrong, do not speak to police without a Motoring Law Solicitor present.
With 24/7 availability, Ashmans Solicitors can provide urgent legal advice and support.
Keep photographs, dashcam footage, insurance messages or other details that may support your defence.
Follow any lawful requirements and allow your solicitor to manage your defence strategy.
