Breach of DVPO Specialists
Being accused of breaching a Domestic Violence Protection Order is serious. You may face immediate arrest, court proceedings and possible imprisonment, often based on allegations that may be misunderstood, exaggerated or disputed. The consequences can escalate quickly, affecting your liberty, reputation and future.
With a team of skilled domestic offence specialists, Ashmans Solicitors is here to assist if:
- You’re facing an urgent domestic abuse order and unsure what happens next.
- You want to challenge the evidence and avoid unnecessary restrictions.
- You need specialist DVPO breach defence lawyers to protect your future.
With Ashmans, you do not have to face this alone. We stand with you at every stage, protecting your rights and challenging allegations or restrictions that are unnecessary, disproportionate or unjustified.
Breach of DVPO and the Law
Under the Crime and Security Act 2010, police can apply for a Domestic Violence Protection Notice (DVPN) followed by a Domestic Violence Protection Order (DVPO), granting temporary restrictions to protect alleged victims of domestic abuse.
- Failing to comply with prohibitions such as returning to an address or contacting a protected person within a breach of DVPO under the Crime and Security Act 2010.
- Engaging in restricted behaviour during a DVPO breach investigation process.
- Committing a criminal offence or contempt through non-compliance under a breach of DVPO legal procedure.
- A valid DVPO was in force and properly served, forming a prosecution for breach of DVPO in the court.
- The defendant knowingly breached a condition of the order under a contested DVPO breach defence strategy.
- The breach occurred without reasonable excuse under a breach of DVPO offence before a criminal court.
Evidence may include witness statements, police body-worn footage, communication records and location data. Cases are usually heard in the Magistrates’ Court.
Breach of a DVPO is not a separate criminal offence, but it can result in arrest and being brought back before the court. Our domestic offence lawyers analyse the order, evidence and procedure carefully to challenge inconsistencies and protect your position under the law in England and Wales.

Essential actions against accusations
From the moment a Domestic Violence Protection Notice is served, a DVPO is made or a breach is alleged, your actions can directly influence the outcome. Immediate and informed steps are critical. Follow these steps:
Act quickly. Engage Ashmans. Protect your home, your reputation and your future.
Do not contact the complainant directly or indirectly, and do not attempt to resolve matters yourself. Messages through third parties or social media can be relied on in court and may amount to a breach.
If you are required to attend a DVPO hearing, arrested or invited for interview about an alleged breach, do not provide statements without your solicitor present. Even informal explanations can affect your defence.
DVPO hearings are listed quickly, often within 48 hours of a DVPN being issued. Early representation allows us to prepare your case, challenge evidence and protect your position from the outset.
Keep messages, call logs, CCTV footage, location data and witness details that may assist your defence. Do not delete anything, even if you believe it is unimportant.
Until varied or discharged by the court, a DVPO must be followed precisely. Breach can result in arrest and further court proceedings. Leave strategy and variation applications to your legal team.
