Unauthorised Computer Access and the Law.
Under section 1 of the Computer Misuse Act 1990, it is a criminal offence to cause a computer to perform any function with intent to access data without authorisation. The Act applies to all digital devices from personal computers and mobile phones to servers and online databases.
- Accessing a computer system without permission.
- Causing a system to perform a function to obtain or modify data.
- Doing so intentionally and knowing authorisation is absent.
- Caused a computer to perform a function with the purpose of accessing data.
- Knew or believed the access was unauthorised.
- Acted intentionally rather than accidentally.
Investigations may involve the National Crime Agency, Crown Prosecution Service and specialist police cyber units. Depending on the case, HMRC, the FCA or the Serious Fraud Office may also become involved where financial or corporate offences are alleged.
